I had got a ticket for “failure to obey a traffic device”. I took a AAA defensive driving course, and they said that it would erase my points. When I was shopping for car insurance, GEICO said that I had the ticket on file, which ended up raising my car insurance. They said that it would be on file for 5 years. I thought the defensive driving course would remove the ticket from file. How is this possible?!
That makes sense, but it isnt fair! I have a friend(who is highly attractive) who has been stopped over 12 times, and got NO TICKETS!!! As for me, I was stopped once and got slammed. And I am a little quiet quy, so it wasnt like I was intimidating or ill mannered. Oh well!
I just checked yahoo! answers, and there are other people in NY with the same problem. It seems your points are removed, but the ticket still stays with you for 5 years, and it does shoot up your insurance. With the defensive driving course though, you get a slight discount, which does count(considering the speeding ticket will leave you eating Ramen Noodles for a long time.)

    It doesn’t erase the occurance nor the ticket, just the points from your license most likely. So you may have to live with the ticket for five years, but at least you are less likely to have your license suspended or revoked if you get another ticket in that time frame. My friend was offered the same thing out of state, and he just took the ticket. Insurance was going to be the same, and he’d have to go back for some class in a state he rarely drives in, so he said forget it and took the hit.

    You have to go to traffic school to keep the points off your DMV record. I don’t know if the course you took was traffic school or not. In CA tickets are on your DMV record for only 3 years for minor violations.

    And, rules are different in every state so check with the court or the DMV.

    My 17 year old daughter had to take a defensive driving course because she ‘binged’ a car in the back end (on a rainy day w/ wet roads). She was ordered by the courts to take the class but was told that it would not remove any points from her record. Sorry!

    The driving course does not remove the citation, only the points. Driving school would have removed the citation and the points.

State Farm, as like all insurance companies, would require that you sign a Release, prior to them issuing any checks.

By signing the release you are stating that you are accepting the amount they offered, and that you are releasing state farm and their insured from any other claims, and will not pursue them for any more money.

It is possible that your lawyer may have signed on your behalf. But your lawyer would have had to have Power of Attorney over you. You would have to originally signed a Power of Attorney stating your lawyer can act and answer on your behalf without you present.
